GBL 399-Z: The State-Level Layer
New York General Business Law Section 399-Z creates a state-level Do Not Call registry and restricts telemarketing calls to residential subscribers. The exemptions are narrower than the federal TCPA - established business relationships, for example, have a shorter lookback window under NY rules than under federal rules.
Violations can trigger penalties of up to $11,000 per call, and the NY Attorney General has been active in enforcement. Wholesalers are not exempt: marketing a contract position or seeking to purchase property falls within the statute is reach if the method is unsolicited telemarketing.
NYSAR Emergency Guidance
The New York State Association of Realtors issued guidance advising licensees to avoid unsolicited calls during extended States of Emergency. While this guidance is not statutory, it signals enforcement risk and reputational exposure during declared emergencies.
Non-licensed wholesalers are not directly bound by NYSAR guidance, but the same logic applies: calling during an emergency draws scrutiny. Check whether any emergency declarations are active before launching NY campaigns.

Our VAs cold call your market, an in-house SDR qualifies every interested seller against your criteria, and a follow-up system works the rest. You pay for qualified leads, not hours.
Book a Real Estate Fit CallPractical Compliance for Wholesalers
Scrub against both the national DNC and the NY state registry. Document every consent with timestamps and source records. Train callers to honor opt-outs immediately - NY enforcement does not wait for the federal 10-business-day processing window.
Consider shifting NY acquisition to inbound channels: direct mail that drives calls to you, online leads, and referral networks. The compliance overhead of cold calling in NY often exceeds the marginal lead volume it produces.
Licensing Considerations
Unlike some states, NY does not currently require a real estate license to wholesale, but enforcement interpretation can shift. Marketing "the property" rather than "your contract position" risks crossing into broker activity. Keep your marketing language tight: you are selling your equitable interest, not the real estate itself.
Watch for legislative updates - several states have tightened wholesaling rules since 2024, and NY bills have been introduced in prior sessions. Compliance is a moving target.
VA Horizon Approach
When we work with clients in NY, we recommend a mixed-channel strategy: direct mail sequences that warm up the seller before any phone contact, skip-traced data for targeted outreach, and strict opt-in documentation. Cold calling is not off the table, but it requires tighter protocols than other states.
Our callers are trained on NY-specific scripts that emphasize consent confirmation and immediate opt-out processing. The goal is qualified appointments, not dial volume - and that mentality fits NY is compliance environment.
