Assignment of Benefits (AOB) explained
An AOB lets the contractor bill and collect from the insurer directly, which used to be common practice on storm-restoration jobs across the country. Florida changed that: AOBs are banned outright for residential and commercial property policies issued or renewed on or after January 1, 2023, under HB 7065, codified at Fla. Stat. Section 627.7152.
For policies written before that date, older AOB paperwork still has rules attached. It must contain a written itemized per-unit cost estimate and an indemnification clause, and it may not include rescission, cancellation, or administrative fees. Insurers that offer AOB-restricted policies also have to notify policyholders annually and price the restricted policy lower than an unrestricted equivalent, under Fla. Stat. Section 627.7153.
AOB is not the only tool storm-restoration sales teams use to tie a job to claim approval. A contingency agreement does similar work without transferring the right to collect payment directly, which is why Florida contractors specifically have leaned harder on contingency agreements since the 2023 ban took the AOB option off the table for new and renewed policies.
Why it matters when you're buying
Never build a storm-restoration sales script around AOB paperwork without confirming your state's current rules first. In Florida specifically, AOB cannot be used on any policy issued or renewed since January 1, 2023, so a script or contract template built on old Florida AOB practice is legally out of date and needs to be replaced with a contingency agreement instead.
